Terms and Conditions of Participation

The participation in the "5th Negotiation and Mediation Tournament for Business Professionals" (hereinafter referred to as the Event) is defined by underneath Terms and Conditions.

The event is organized by: Foundation of the Cracow Bar Association, based in Cracow (31-543), ul. Płk. Francesco Nullo 8/4, NIP 675 169 18 41, REGON 38 22 78 966 and by Eveneum Sp. z o. o. Sp.k., with its registered office in Mlodziejowice (32-091), ul. Słoneczny Stok 9, NIP 513 023 53 59, REGON 12 28 94 402 (hereinafter referred to as the Organizer or jointly the Organizers).

§ 1. Negotiation teams

  1. Two or three-person negotiation teams representing one legal entity may participate in the negotiation stream of the tournament.
  2. Members of a two- or three-person negotiating team may come from different departments of one business entity.
  3. The Applicant has the right to change the members of the negotiation team up to 14 days before the start of the Event.
  4. One legal entity may be represented by more than one negotiating team.

§ 2. Reporting of the negotiation team

  1. The person submitting the negotiating team acts on behalf of the members of the team and the represented business entity.
  2. Applications should be made online, via the registration form available at: https://eveneum.com/produkt/turniej-negocjacyjno-mediacyjny-dla-biznesu/.
  3. The organizers, after considering the application, reserve the right to refuse to accept the application within 30 days from the registration of the application.
  4. The organizers reserve the right to end the registration of applications earlier due to the limitation of available places.

§ 3 . Mediators and proxies

  1. Mediators and proxies representing the parties of the conflict may participate in the mediation stream of the tournament.
  2. Each team includes one mediator and two proxies.

§ 4. Application for the mediation tournament

  1. In the mediation part you can apply as:
    • mediator
    • proxy
    • listener (the listener does not take an active part in the tournament, he acts as a spectator)
  2. Applications should be made online, via the registration form available at:https://eveneum.com/produkt/turniej-negocjacyjno-mediacyjny-dla-mediatorow/.
  3. The organizers, after considering the application, reserve the right to refuse to accept the application within 30 days from the registration of the application.

§ 5. Payment for participation in the Event

  1. The registration fee for submitting a negotiation team to 528 EUR without VAT (649,44 EUR with VAT)
  2. The registration fee for submitting a mediator or proxy is 145 EUR without VAT (178,35 EUR with VAT).
  3. Payment is made via the Eveneum Sp. z o. o. sp.k., in accordance with the store regulations: https://eveneum.com/regulamin/
  4. A VAT invoice is issued at the participant's request, after providing the data during the purchase in the Eveneum Sp. z o. o. sp.k.
  5. The Applicant has the right to resign from participation in the Event by 31.07.2023, and the registration fee is non-refundable.

§ 6 . Awards

  1. Prizes are awarded by the Tournament jury , separate for negotiation teams and separate for mediators and proxies.
  2. The list of prizes posted on the website http://negocjacjeimediacje.biz/nagrody/ may change and is indicative only.

§ 7. Logo and name of the entity represented by the negotiating team

  1. The Organizers have the right to place the logo and name of the business legal entity that represents the notified negotiation team in the Event materials: baskets for drawing negotiation pairs, Event website, invitations, audio-visual materials from the Event coverage

§ 8. Information on the processing of personal data

  1. The administrator of the Participants' personal data is the Organizer, i.e. acting jointly as co-administrators: Foundation of the Cracow Bar Association and Eveneum Sp. z o. o. Sp. K. based in Mlodziejowice.
  2. The Administrator can be contacted in all matters related to the processing of personal data:
    • written, by sending correspondence to the address of any of the administrators,
    • electronically, by sending correspondence to the administrator's address, respectively:
    • t.job@oirp.krakow.pl and rafal.dados@eveneum.com
  3. Participants' personal data will be used in accordance with the conditions set out in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/ 46 / WE (OJ L 119, 4.5.2016, p. 1-88, GDPR), the Act of May 10, 2018. on the protection of personal data (i.e. Journal of Laws of 2018, item 1000, UODO), Polish regulations adopted to enable the application of the GDPR, other applicable laws and these Regulations.
  4. Personal data provided in the application for participation/on-line registration will be processed for the purpose and scope related to the organization of the Negotiation and Mediation Tournament. The basis for the processing of personal data by the Organizer is art. 6 sec. 1 letter b) of the GDPR - performance of the contract (acceptance of the Regulations and application for participation in the Tournament as well as acceptance by the Organizer of the application and participation fee constitute the conclusion of the contract). The Organizers may also process the Participants' personal data in order to establish, defend or pursue claims related to the organized Tournament, which is a legitimate interest (Article 6(1)(f) of the GDPR). In this case, personal data will be stored for the period of limitation of claims or criminal acts resulting from the law.
  5. The basis for the processing of personal data for the individually operating Cracow Bar Association is also art. 6 sec. 1 lit. c of the GDPR, because training points will be awarded in connection with participation in the Tournament - to the extent that OIRP in Krakow is obliged to keep their records.
  6. If the Participant has given the consent referred to in § 9 sec. 3, personal data will be processed to the extent necessary to achieve the goal/purposes for which consent was given, until the consent is withdrawn by the Participant. The basis for the processing of personal data is art. 6 sec. 1 lit. a) GDPR - voluntary, unambiguous, informed and specific consent of the data subject. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
  7. Participants' data may be made available by the administrator to entities acting on behalf of and on behalf of the administrator (e.g. technical service companies). In the event of granting the consent referred to in §9 sec. 3, image data will be made available to an unlimited number of recipients by making it public in the manner specified in the consent.
  8. The administrator does not transfer data to a third country/international organization, subject to the disclosure referred to in §9 para. 3.
  9. Participants' personal data will not be subject to automated processing, including profiling.
  10. Participants have the right to:
    • access to data,
    • rectification of data,
    • deletion of data,
    • data processing restrictions,
    • the right to transfer data,
    • opposition
    • withdrawal of consent to data processing.
  11. The exercise of the rights referred to above may take place by sending a written request in the manner indicated in section 1.
  12. Participants also have the right to lodge a complaint to the President of the Office for Personal Data Protection against the processing of their data by any of the administrators.
  13. Providing personal data by the Participant is voluntary, but necessary to participate in the Tournament.
  14. If the Participant does not provide data, he may lose the opportunity to participate in the Tournament. Lack of consent may prevent the provision of services in connection with the Tournament.

§ 9. Final provisions

  1. The Organizer is entitled to record the course of the Tournament using video and sound recording devices.
  2. Based on Art. 81 sec. 2 of the Act of February 4, 1994 on copyright and related rights (Journal of Laws of 2018, item 1191, as amended), a permit does not require:
    • dissemination of the image of a well-known person, if the image was made in connection with the performance of public functions, in particular political, social, professional;
    • a person who is only a detail of a whole, such as an assembly, a landscape, a public event;
    • however, the images of the Tournament Participants recorded in this way may be disseminated in the form of photos or videos.
  3. Notwithstanding the provision indicated in par. 2, the Participant, during the application for participation in the Tournament, agrees to the free use, recording, processing, duplication, dissemination of the image recorded in the form of a photograph or video recording and granting the Organizer a non-exclusive, unlimited in terms of territory and time, free consent to use the image recorded in connection with participation in the Tournament for information, promotional and advertising purposes related to the Tournament or activities in the following scope:
    • recording and multiplication by any known technique and dissemination in any form,
    • introduction to computer memory and multimedia network,
    • multiplication of the recorded image,
    • public display, display, playback, broadcasting and re-broadcasting, as well as making it publicly available in such a way that everyone can access it at a place and time of their choice,
    • posting and publishing in the press, on websites, posters and billboards, social networks,
    • broadcasting on television and radio.
  4. The Organizer is not responsible for items left or lost by the Participants in the place of the Tournament.
  5. Participants bear full financial responsibility for any damage they cause in the premises where any activities related to the Tournament are carried out.
  6. In matters not covered by the Regulations, the provisions of Polish law shall apply.
  7. For the settlement of any disputes with foreign participants of the Tournament, the text of the Regulations in Polish is accepted as the binding text, and the law applicable in interpreting the provisions of the Regulations is Polish law.
  8. Any disputes that may arise between the Tournament Participant and the Organizer will be settled by the court competent for the seat of the Organizer.
  9. These Regulations come into force on the day of its posting on the Website.
  10. The Organizer has the right to change the provisions of the Regulations. Changes will be published on the Website.

Consent when registering:

"I consent to the processing of my personal data by the Organizer of the Negotiation and Mediation Tournament: Foundation of the Cracow Bar Association and Eveneum. sp. z o. o. sp.k. based in Mlodziejowice,

in order to register and participate in the Negotiation and Mediation Tournament, including at receiving tournament-related communications via e-mail.

Providing data is voluntary, but necessary to register and participate in the Tournament.

 I am aware of my right to access my data, the possibility of correcting it,

and requesting discontinuation of its processing".

 

"I consent to the free use, recording, processing, duplication, dissemination of the image recorded in the form of photography or video recording, and granting the Organizer a non-exclusive, unlimited territory and time, free consent to use the image recorded in connection with participation in the Tournament for information, promotional, advertising related to the Tournament in the following scope:

1) recording and multiplication by any known technique and dissemination in any form,

2)  placing it in the computer's memory and multimedia network,

3) multiplication of the recorded image,

4) public exposure, display, reproduction as well as broadcasting and re-broadcasting, as well as making it publicly available in such a way that everyone can have access to it in a place and at a time chosen by them,

5) placing and publishing in the press, on websites, posters, billboards and social networking sites,

6) broadcasting in television and radio transmissions".
